These Terms and Conditions (“Terms”) apply to the use of the VacRock NY Inc. website, communications with VacRock NY Inc., and services provided by VacRock NY Inc. By using our website, submitting a service request, scheduling an appointment, accepting an estimate, or using our services, you agree to these Terms.

2. Services Provided

VacRock NY Inc. provides HVAC installation, HVAC repair, HVAC maintenance, HVAC diagnostics, refrigeration service, ductwork, ventilation, air duct cleaning, dryer vent cleaning, and related residential and commercial services.

Service availability may depend on property access, site conditions, equipment condition, parts availability, technician availability, safety conditions, and project requirements.

3. Estimates and Pricing

Any estimate, quote, or proposal provided by VacRock NY Inc. is based on the information available at the time it is prepared. Final pricing may change if additional work, materials, access limitations, hidden conditions, unsafe conditions, equipment defects, or other unforeseen circumstances are discovered.

Any additional work or price change will be explained and approved before additional work begins, unless emergency action is required to protect equipment, property, or safety.

Taxes are not included unless specifically stated in writing.

4. Service Calls and Diagnostics

Service calls and diagnostic visits are intended to inspect, test, troubleshoot, and evaluate HVAC, refrigeration, ventilation, duct, dryer vent, or related systems.

A service call does not guarantee that every hidden, intermittent, concealed, internal, or future issue will be identified during the visit.

Additional repairs, parts, refrigerant, deep cleaning, return visits, specialized testing, or extended diagnostics may require a separate quote.

5. Customer Access and Site Conditions

The customer is responsible for providing safe and reasonable access to the work area, equipment, mechanical rooms, rooftops, electrical panels, thermostats, indoor units, outdoor units, drains, ductwork, and any other areas required for service.

If VacRock NY Inc. arrives on site and the agreed scope of work cannot be completed due to client-related conditions, including but not limited to access restrictions, lack of authorization, unsafe conditions, unavailable equipment, locked areas, tenant restrictions, or site unavailability, the agreed service charge may remain due and payable.

6. Payments

Payment is due according to the invoice, estimate, proposal, or written payment terms provided by VacRock NY Inc.

VacRock NY Inc. may require a deposit before scheduling work, ordering materials, purchasing equipment, or beginning a project.

Work may be paused, delayed, or canceled if required payments are not received on time.

Credit card or debit card payments may be subject to processing fees where permitted by law.

7. Parts, Materials, and Equipment

Parts, materials, and equipment are subject to availability. Lead times may vary based on manufacturer, supplier, shipping, and market conditions.

Special-order materials, equipment, and parts may be non-refundable once ordered, depending on supplier policy.

Any substitutions or changes may require customer approval before installation.

8. Warranty and Workmanship Guarantee

VacRock NY Inc. may provide a workmanship guarantee of up to 12 months, depending on the job and written scope of work.

Manufacturer warranties are provided by the manufacturer and are subject to manufacturer terms and requirements.

Warranty or workmanship coverage may not apply to pre-existing conditions, customer-supplied equipment, lack of maintenance, misuse, improper operation, work performed by others, inaccessible components, refrigerant leaks not repaired by VacRock NY Inc., power issues, control issues, drain issues caused by lack of maintenance, or conditions outside the original scope of work.

9. Refrigerant, Leak Detection, and System Performance

If a system is low on refrigerant, this may indicate a leak. Recharging a system without repairing an existing leak may be temporary and does not guarantee how long the refrigerant or pressure will hold.

Leak detection, leak repair, pressure testing, vacuuming, and recharging may require separate approval and may be quoted separately.

System performance depends on equipment condition, installation quality, airflow, controls, electrical supply, refrigerant charge, maintenance history, and site conditions.

10. Mold, Microbial Growth, and Indoor Air Quality

VacRock NY Inc. may provide HVAC cleaning, duct cleaning, coil cleaning, blower cleaning, ventilation cleaning, and related system services where applicable.

Unless specifically stated in writing and performed under applicable licensing requirements, VacRock NY Inc. does not provide mold assessment, mold clearance, or mold remediation services.

Any suspected mold condition should be evaluated by a properly licensed mold professional where required by law.

11. Photos, Reports, and Documentation

VacRock NY Inc. may document job conditions, equipment, findings, completed work, safety concerns, and recommendations through photos, videos, notes, invoices, estimates, and service reports.

Service reports are intended to summarize visible findings, work performed, and recommendations based on the conditions observed at the time of service.

12. SMS/Text Messaging Terms

By opting in to SMS communications from VacRock NY Inc., you agree to receive text messages regarding service requests, appointment scheduling, appointment reminders, technician arrival updates, job status updates, estimates, invoices, service reports, follow-ups, customer support, review requests, and promotional offers where permitted by law.

Message frequency may vary. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for assistance. Consent is not a condition of purchase.

No mobile opt-in data or text message consent will be shared with third parties or affiliates for marketing or promotional purposes.

13. SMS Consent Methods

Customers may provide SMS consent through written opt-in or verbal opt-in.

Written Opt-In: Customers may provide written consent by submitting a website contact form, service request form, estimate request form, or booking form that includes SMS opt-in language. The SMS opt-in checkbox must be manually selected by the customer and must not be pre-checked.

Verbal Opt-In: Customers may provide verbal consent during a phone call. When verbal consent is obtained, a VacRock NY Inc. representative reads the SMS consent disclosure to the customer and records the customer’s consent in the customer or job record before sending SMS messages.

14. Verbal SMS Opt-In Script

When speaking with customers by phone, VacRock NY Inc. may ask for verbal SMS consent using the following script:

If the customer agrees, VacRock NY Inc. records the verbal consent in the customer or job record before sending SMS messages.

15. Opt-Out and Help Instructions

You may opt out of SMS messages at any time by replying STOP. After you reply STOP, we may send a confirmation message that you have been unsubscribed. After that, you will no longer receive SMS messages from us unless you opt in again.

16. Limitation of Liability

VacRock NY Inc. is not responsible for damages caused by pre-existing conditions, hidden defects, improper prior installation, lack of maintenance, inaccessible components, customer-supplied equipment, work performed by others, building conditions, electrical issues, water damage unrelated to our work, manufacturer defects, or conditions outside the approved scope of work.

17. Website Use

You agree not to misuse our website, submit false information, interfere with website operation, attempt unauthorized access, or use the website for unlawful purposes.

18. Third-Party Links

Our website may contain links to third-party websites. VacRock NY Inc. is not responsible for the content, security, terms, or privacy practices of third-party websites.

19. Changes to These Terms

VacRock NY Inc. may update these Terms and Conditions from time to time. The updated version will be posted on our website with a new effective date.

Your continued use of our website or services after changes are posted means you accept the updated Terms.
